The 45-Class System
China uses the Nice Classification system, dividing all goods and services into 45 classes. Classes 1-34 cover goods, while Classes 35-45 cover services. Choosing the right classes is one of the most consequential decisions in your trademark application — file in too few classes and your protection is incomplete; file in too many and you waste money on unnecessary fees.
Key Classes for Most Brands
Class 9 — Computer Software & Electronics
Covers downloadable software, mobile apps, computers, and electronic devices. Essential for tech companies and SaaS businesses entering China.
Class 25 — Clothing & Footwear
One of the most heavily filed classes in China. Covers all types of clothing, shoes, and headwear. If you're in fashion, this is non-negotiable.
Class 35 — Business Services & Retail
Often called the 'universal class' in China. It covers advertising, business management, retail services, and — critically — online marketplace services. Many foreign brands underestimate Class 35, but in China's e-commerce-driven economy, it's arguably the most important class. Without Class 35, you cannot legally operate a branded store on Tmall, JD.com, or other platforms.
Class 41 — Education & Entertainment
Covers educational services, training, publishing, and entertainment. Important for content creators, edtech companies, and media brands.
Class 42 — Scientific & Technical Services
Covers software development, SaaS platforms, scientific research, and IT consulting. Critical for technology companies.
Classification Pitfalls
- Subclass system: China uses a detailed subclass system within each class. Two marks in the same class but different subclasses may not conflict. However, cross-subclass similarity is still examined if goods/services are related.
- CNIPA interpretation: Some goods/services descriptions accepted in other countries may be rejected by CNIPA. Always use the official Chinese Classification Table's standard terms.
- Multi-class vs single-class: China accepts multi-class applications, but CNIPA examines each class independently. A rejection in one class won't affect others, but you'll need separate responses.

- Consider expansion: What might you sell in the next 3-5 years?
- Check competitors: What classes have they registered in?
