Two Paths, Different Windows
Chinese trademark law provides two main mechanisms for third-party challenges:

Strategic Considerations
When to Use Opposition
- You've caught the problematic application during the 3-month publication window
- You want to block the mark before it becomes a registered right
- The mark is a clear conflict and you have strong evidence ready
- Cost is a significant concern (opposition is generally cheaper than invalidation)
When to Use Invalidation
- The mark has already registered (you missed the opposition window or only recently learned of it)
- You need to challenge a mark that was registered before you entered the Chinese market
- You have new evidence not available during the opposition period
- The registered mark is being actively used and causing market confusion
Can You Do Both?
Technically yes — you can file both an opposition AND a parallel invalidation. However, CNIPA typically stays one proceeding pending the outcome of the other. The opposition usually takes priority since it's earlier in the process.
Evidence Considerations
The same evidence generally works for both, but in invalidation proceedings, the evidentiary standard is slightly higher because you're overturning an existing registered right rather than preventing one from arising.
Key evidence types: Prior registration certificates, evidence of prior use and reputation in China, evidence of the applicant's bad faith, copyright registrations, and consumer survey data.
Cost Comparison
- Opposition: Official fee ~RMB 500 + agent fees (typically RMB 3,000-8,000)
- Invalidation: Official fee ~RMB 1,500 + agent fees (typically RMB 8,000-20,000)
