China Trademark Opposition vs. Invalidation: What's the Difference and When to Use Each

Strategic Considerations

When to Use Opposition

When to Use Invalidation

Can You Do Both?

Technically yes — you can file both an opposition AND a parallel invalidation. However, CNIPA typically stays one proceeding pending the outcome of the other. The opposition usually takes priority since it's earlier in the process.

Evidence Considerations

The same evidence generally works for both, but in invalidation proceedings, the evidentiary standard is slightly higher because you're overturning an existing registered right rather than preventing one from arising.

Key evidence types: Prior registration certificates, evidence of prior use and reputation in China, evidence of the applicant's bad faith, copyright registrations, and consumer survey data.

Cost Comparison

Opposition is not only faster but significantly cheaper. Set up Gazette monitoring to catch problematic applications during the opposition window.
