The E-Commerce Enforcement Landscape
China's e-commerce market is the world's largest, with platforms like Tmall, JD.com, Pinduoduo, and Douyin (TikTok China) generating trillions of RMB in sales annually. For brand owners, these platforms are both opportunity and risk — counterfeiters and unauthorized sellers thrive without active enforcement.
The good news: all major Chinese e-commerce platforms have intellectual property protection systems. The bad news: you need a Chinese trademark registration to use them effectively.
Platform-by-Platform Guide
Alibaba Group (Tmall, Taobao, 1688, AliExpress)
Alibaba's IP Protection Platform (IPP) is the most mature. To file complaints:
- Create an IPP account with your business license and trademark certificate
- Submit takedown notices for infringing listings
- Processing time: 2-5 business days for straightforward cases
- Alibaba also offers a proactive monitoring program (Alibaba Anti-Counterfeiting Alliance)
Required: Chinese trademark registration certificate.
JD.com
JD's IP protection system is similar but more stringent. JD typically requires:
- Chinese trademark registration (applications alone are insufficient)
- Proof of authorization for your legitimate distributors
- Purchase testing evidence for counterfeiting claims
Pinduoduo
Pinduoduo has rapidly expanded its IP protection capabilities. The platform is particularly aggressive against counterfeit goods. Filing a complaint requires a Chinese trademark registration number.
Proactive Monitoring Strategy
- Regular keyword searches: Search your brand name (English + Chinese) on all major platforms weekly
- Image recognition monitoring: Use tools that scan product images for your logo or packaging
- Price monitoring: Unusually low prices often indicate counterfeits
- Test purchases: Buy suspected counterfeits to gather evidence
- Record with customs: Register your trademark with China Customs for border enforcement
The Golden Rule
Without a Chinese trademark registration, platform IP protection systems offer no recourse. They will not accept complaints based on foreign registrations alone. File your Chinese trademark before you need to enforce it.
